3M has now accelerated its Payment Schedule as this overwhelming support inspired it to ensure that $253 Million is released by the end of January.
First, by the end of December 3M’s Payments were $250 Million to more than thirty thousand claimants. The prepayment of an extra $253 Million adds emphasis to the vitality in support for settlement. Having the nearly unanimous acceptance from a total of 276,00 Claimants is one important component to validate the settlement.
Lawyers of the plaintiffs seem hopeful that they will cross over 98 Percent Participation. Attorney Bryan Aylstock praised 3M for its decision to speed up payments and predicted the settlement’s number of supporters would continue expanding during the following weeks.
The lawsuit, signed in August after almost Five Years of Litigation and now one of the biggest mass torts in US History. 3M Subsidiary Aearo Technologies manufactured Combat Arms earplugs that damaged hearing for over 250,000 Military Personnel.

3M received approval from a federal judge earlier this month to issue stock worth $1 Billion for settlement purposes. While as the greater settlement related to PFAS that contaminates drinking water, which was announced last year is heading towards its final hearing in May this may be valued up to $12.5 Billion.
Last week the judge supervising this case warned cities and public utilities to accept the settlement, telling them that if they did not do so litigation until near future 2030 would stretch out.
A newly released modification indicates that all “Wave” Plaintiffs who were previously ready for trial prior to settling have been incorporated into the majority group. This unanimous participation is another step toward the complete implementation of the settlement.
Having recognized this unwavering backing, 3M and Aearo have amended the settlement agreement timing to align with the full participation of all remaining wave claimants. Total payments of $253.1 Million will be fast-tracked by January 31, 2024.
