The FDA has authorized the marketing of four new menthol vape products from NJOY, marking the first time non-tobacco flavored e-cigarettes have received such approval. This decision aims to help adult smokers switch to a less harmful alternative, despite concerns about youth appeal.
The FDA announced the authorization of NJOY‘s menthol vape products, emphasizing that this does not equate to the products being safe or “FDA-approved”.
The approval came after NJOY provided evidence suggesting the benefits of helping adult smokers switch outweighed potential risks.
This approval is significant as it’s the first time menthol-flavored e-cigarettes have received the green light from the FDA.
To mitigate youth appeal, the FDA has imposed stringent marketing restrictions on these menthol vape products.
They plan to closely monitor their marketing efforts and may suspend or withdraw authorization if there’s a marked increase in youth usage or a decrease in smokers switching.
The FDA approved four specific products: NJOY ace pod menthol 2.4%, NJOY ace pod menthol 5%, NJOY daily menthol 4.5%, and NJOY daily extra menthol 6%. Two of these are refillable pods for the ACE device, while the other two are disposable e-cigarettes.
This approval highlights NJOY‘s commitment to providing alternative options for adult smokers.
The approval of these menthol vape products has not been without controversy. Tobacco-control advocates argue that menthol products cause disproportionate harm, particularly to Black smokers, who have been targeted by menthol cigarette marketing for decades.
Critics, including Yolonda C. Richardson, CEO of the Campaign for Tobacco-Free Kids, find the FDA’s decision troubling given the youth vaping epidemic.
A recent National Youth Tobacco Survey found that nearly 1 in 4 high school e-cigarette users favored menthol-flavored products.
This statistic raises significant concerns, as the FDA itself has recognized the substantial risk of youth uptake and use of flavored e-cigarettes, including menthol.
Matthew Farrelly from the FDA’s Center for Tobacco Products stated that the agency evaluates evidence on a case-by-case basis.
In the case of NJOY’s menthol vape products, the evidence of benefits to adult smokers switching to less harmful alternatives was deemed sufficient to outweigh the risks to youth.
This approval comes amidst ongoing debates and legal challenges regarding menthol products. Earlier this year, the Biden administration delayed a proposed ban on menthol cigarettes, facing opposition from the tobacco industry and civil rights groups.
